Welcome to Mindful Plate (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Mindful Plate mobile application (“App”) and related services (collectively, the “Service”).

By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 16 years old to use Mindful Plate. By using the Service, you represent that you meet this requirement.

3. Account Registration

To access certain features, you may be required to create an account. You agree to:

• Provide accurate and complete information.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized use of your account.

You are responsible for all activities that occur under your account.

4. Use of the Service

Mindful Plate offers tools to help you track your meals, analyze eating patterns, and receive food-related insights. The Service may include AI-powered estimates, food recognition, calorie approximations, and personalized tips.

You agree to use the Service only for lawful, personal, and non-commercial purposes.

• Informational Purpose Only: Mindful Plate provides informational and motivational content. It is not intended as medical, nutritional, or professional advice.
• No Medical Advice: Always consult a qualified healthcare provider before making dietary, health, or fitness changes. Mindful Plate is not a substitute for professional healthcare guidance.
• AI Limitations: Our AI technology aims to provide useful insights but may occasionally make errors. Nutritional information and recommendations are estimates and should not be solely relied upon for critical decisions.

6. Privacy and Data Protection

We respect your privacy. Our use of your personal data is governed by our Privacy Policy.

• Your data may be processed and stored in accordance with the EU General Data Protection Regulation (GDPR).
• You may request access to, correction of, or deletion of your personal data at any time.
• We implement appropriate technical and organizational measures to safeguard your data.

7. Payments and Subscriptions

Some features of Mindful Plate may be offered under a paid subscription (“Premium”). All purchases are handled through the App Store or Google Play under their respective terms.

• Renewals: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Refunds: Refund requests are subject to the policies of the App Store or Google Play. We do not offer direct refunds.

8. Acceptable Use

• Use the Service for any unlawful or fraudulent purposes.
• Attempt to gain unauthorized access to systems or networks.
• Upload content that is harmful, abusive, defamatory, or otherwise objectionable.
• Reverse-engineer, decompile, or modify any part of the Service.

We reserve the right to suspend or terminate your account if you violate these rules.

9. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, software, and AI models, is the property of Mindful Plate or its licensors and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

Mindful Plate may integrate or link to third-party services. We are not responsible for the content, policies, or practices of any third parties. Your use of third-party services is subject to their separate terms.

11. Modifications to the Service

We may modify, update, or discontinue parts of the Service at any time without liability. We will make reasonable efforts to inform users of significant changes affecting their use of the Service.

12. Termination

• We may suspend or terminate your access to the Service at any time if you violate these Terms or if required by law or regulatory obligations.
• You may terminate your account at any time by deleting it within the App or contacting us.

13. Limitation of Liability

To the maximum extent permitted by law:

• Mindful Plate shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Service.
• Our total liability for claims under these Terms shall not exceed the amount you paid us (if any) in the past 12 months.

14. Indemnification

You agree to indemnify and hold harmless Mindful Plate, its directors, officers, employees, and partners from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service or violation of these Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to conflict of laws principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Tallinn, Estonia.

16. Changes to These Terms

We may revise these Terms from time to time. If we make significant changes, we will notify you through the Service or by other means.

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
